1. Agreement to These Terms

By accessing or using the website and services available at FixYourFinances.app (the “Service”), you agree to these Terms and Conditions (“Terms”). If you do not agree, do not use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization, and “you” includes that organization.

2. The Service

FixYourFinances.app is an online directory and discovery platform that helps consumers find financial coaches. We may display coach profiles, location-based search and maps, contact and lead forms, and tools for coaches who register for paid or promotional plans. Features may change over time. We do not guarantee uninterrupted or error-free operation.

3. Eligibility and Accounts

You must be at least eighteen (18) years old—or the age of majority where you live—to use the Service in a legally binding way. Certain coach-facing features may require creating an account, choosing a plan, and maintaining accurate profile information. You are responsible for safeguarding your credentials and for all activity under your account. Notify us promptly if you suspect unauthorized access.

5. Coach Listings, Fees, and Leads

Directory listings and coach-facing plans are governed by separate order flows, plan descriptions, and these Terms. Fees, billing cycles, and refund rules are as stated at checkout or in plan documentation at the time of purchase unless otherwise required by law. When a visitor submits information through a contact or lead form on a coach’s profile, that information is routed so the coach (or our operations team as configured) can respond; you are responsible for your own communications and for complying with laws that apply to your practice (including marketing, recordkeeping, and licensing).

6. Acceptable Use

You agree not to:

• Violate any applicable law or regulation;
• Infringe intellectual property or privacy rights of others;
• Transmit malware, attempt to gain unauthorized access, or probe or stress the Service except as part of good-faith security research we have authorized in writing;
• Use the Service to harass, defraud, impersonate, or mislead others, or to send unsolicited spam at scale;
• Scrape, resell, or systematically download directory data in bulk without our prior written consent;
• Interfere with other users’ use of the Service or with our networks or suppliers.

We may investigate and take appropriate action—including removing content, suspending accounts, or contacting authorities—if we believe there is a violation.

7. Intellectual Property

FixYourFinances branding, site design, software, and original content (excluding coach-supplied materials) are owned by Neon Ink or our licensors and are protected by intellectual property laws. Subject to these Terms, we grant you a limited, non-exclusive, non-transferable right to use the consumer-facing Service for personal, non-commercial use. Coaches grant us a license to host, display, and distribute their submitted profile and marketing content as needed to operate the Service.

8. Third-Party Links and Services

The Service may link to or integrate with third-party websites, maps, payment processors, email delivery, or other tools. Those third parties have their own terms and privacy practices. Your use of third-party services is at your own risk and between you and the third party.

9. Disclaimers

The Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, to the fullest extent permitted by law. We do not warrant that coach profiles are complete, current, or accurate, or that any coach is licensed, qualified, or suitable for your needs. You choose coaches and engage professionals at your own risk.

10. Limitation of Liability

To the fullest extent permitted by law, Neon Ink and its affiliates, officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, data, goodwill, or business opportunities, arising from or related to the Service or these Terms, even if we have been advised of the possibility of such damages.

To the fullest extent permitted by law, our aggregate liability for all claims arising from or related to the Service or these Terms will not exceed the greater of (a) one hundred U.S. dollars (USD $100) or (b) the amount you paid Neon Ink for the Service in the twelve (12) months before the claim arose (if any). Some jurisdictions do not allow certain limitations; in those cases, our liability is limited to the maximum permitted by law.

11. Indemnification

You will defend, indemnify, and hold harmless Neon Ink and its affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising from your use of the Service, your profile or listings, your violation of these Terms, or your violation of applicable law or third-party rights.

12. Suspension and Termination

We may suspend or discontinue all or part of the Service, or suspend or terminate your access, with or without notice, for conduct that we believe violates these Terms or harms the Service, users, or third parties. Provisions that by their nature should survive (including intellectual property, disclaimers, limitations of liability, indemnity, and governing law) will survive termination.

13. Governing Law and Disputes

These Terms are governed by the laws of the United States and the State of Florida, excluding conflict-of-law rules that would require applying another jurisdiction’s laws. You and Neon Ink agree that the state and federal courts located in Florida will have exclusive jurisdiction for disputes arising from or relating to these Terms or the Service, and you consent to personal jurisdiction there. If you are a consumer, mandatory protections in the jurisdiction where you live may still apply.

14. Changes

We may update these Terms by posting a revised version on this page and updating the effective date. If changes are material, we may provide additional notice (such as a banner or email where appropriate). Your continued use of the Service after the effective date constitutes acceptance of the revised Terms where permitted by law. If you do not agree, you must stop using the Service.
